Carlson Caspers, a top-ranked intellectual property law firm, is pleased to announce that Minnesota Lawyer has recognized Carlson Caspers’ Patent Litigation Team, Philip Caspers, Sam Hamer and William Bullard as Attorneys of Year (“Groups”), 2022, for their litigation victory on behalf of client, CommScope Technologies LLC.
Philip Caspers, a founding member of Carlson Caspers Vandenburgh & Lindquist, led a litigation team, including Samuel Hamer and William Bullard for CommScope Technologies, in a dispute involving their client CommScope’s distributed antenna technologies that were litigated in federal district court in Texas, Delaware, before the Federal Circuit Court of Appeals, and before the United States Patent and Trademark Office. The Carlson Caspers team successfully enforced five patents against Dali Wireless and defeated multiple patent infringement accusations by Dali Wireless, obtaining a final judgment of non-infringement for the last accusation in March of 2022.
The winning plan included actions in district court and before the Patent Trial and Appeal Board (PTAB). The team successfully challenged multiple Dali patents with petitions for inter partes review. This procedure allows for the validity of patents to be retried at the patent office. Convinced by the arguments the Carlson Caspers team submitted, the Board issued a preliminary decision instituting validity trials against Dali patents. Faced with the evidence the Carlson Caspers team marshalled, the patentee agreed to cancel multiple patent claims and dismiss its counts for infringement on several patents. A remaining patent was disposed of in the U.S. District Court for Delaware, where the team won summary judgment of non-infringement before U.S. District Judge Maryellen Noreika.
Bottom line: Carlson Caspers, on behalf of CommScope, went five for five in successfully enforcing CommScope patents and went eight for eight in successfully defeating all of Dali’s patents.
